Circular of the Ministry of Commerce on Doing Well the Work of Enterprise Certification and Market Exploring of the Thousand-hundred-ten Project of Service Outsourcing Shang Zi Han[2006] No.110 In order to accelerate the development of service outsourcing of our state, support the outsourcing enterprises to make bigger and stronger and to take the business of international (offshore) service outsourcing actively, and promote the shift of growth mode of foreign trade, according to the Measures for the Administration of International Market Exploring Fund for Medium and Small Enterprises and the Rules for the Implementation of the Measures for the Administration of International Market Exploring Fund for Medium and Small Enterprises (hereinafter abbreviated as Measures of Exploring Fund) as well as the working requirements made by the Ministry of Commerce for the Thousand-hundred-ten Project of servicing outsourcing, related affairs concerning that the international market exploring fund for medium and small enterprises (hereinafter abbreviated as the Exploring Fund) shall be used to support service outsourcing enterprises for international certification and market exploring, and related affairs are notified hereby as follows: 1. The state encourages and supports service outsourcing enterprises to acquire international certification, explore international market and take the business of international (offshore) service outsourcing, and continuously improve the service value. 2. Service outsourcing enterprises refer to the enterprises who, based on the long-or-middle-term service contracts concluded with the providers of service outsourcing business, offer outsourcing service to their clients. Service outsourcing business refers to ITO (Information Technology Outsourcing) and BPO (Business Process Outsourcing) offered by service outsourcing enterprises to their clients. It includes the outsourcing of reconstruction business, the outsourcing of business process and business process service, the outsourcing of commercial application processes including application management and application service, etc, and the outsourcing of fundamental technology (IT, development and design of software, research and development of technology, unification of fundamental technical platform and unification of management), etc. International (offshore) service outsourcing means that the service outsourcing enterprises provide service outsourcing business for the clients outside the boundary. 3. International certification hereof includes that of Capability Maturity Model Integration (CMMI), Capability Maturity Model (CMM), People Capability Maturity Model (PCMM), Standards of Information Security Management (ISO27001/BS7799), IT Service Management (ISO20000) and Environment Security of Service Provider (SAS70), etc. 4. Service outsourcing enterprises acquires international certification, including enterprises get international certification in the present year, upgrading certification or maintaining and improving the certification in the following two years, may, according to related provisions of the Measures of Exploring Fund and this Circular, apply for the support of Exploring Fund. Commercial authorities involved shall make an overall arrangement and give a priority consideration to such enterprises. 5. The local governments using the Exploring Fund shall, from the available special financial fund, arrange a complementary exploring fund (hereafter abbreviated as the complementary exploring fund) of no less than the amount of the Exploring Fund, to support the service outsourcing enterprise to maintain and further improve the acquired international certification. 6. All the qualified service outsourcing enterprises with certification of CMM and CMMI, may apply for the award of the Exploring Fund after getting every certification. According to the provisions of the Measures of Exploring Fund, in principle, the amount of award shall be no more than 50% of the certification cost, with the maximum of 0.5 million RMB Yuan. In the following two years, in order to maintain and improve the acquired certification, the local governments shall award, using the complementary exploring fund, to these enterprises, with the amount of not less than that of the Exploring Fund. Service outsourcing enterprises acquiring PCMM or other certification, may apply for the award with reference to the aforementioned measures, and the amount of the Exploring Fund award shall be fixed by the Ministry of Commerce according to the reasonable cost of different international certification. In the following two years, local governments shall grant such enterprises an annul award of an amount not less than that of the Exploring Fund. Such service outsourcing enterprises that acquire multiple international certifications and upgrading certification, may file no more than three applications. 7. When the qualified service outsourcing enterprises get international certification and engage in the business of international market exploring, or obtain other certification beyond the scope of article three hereof, may apply for financial support according to related provisions of the Administration Measures and the Implementation Rules. 8. Service outsourcing enterprises may file applications, provided that they: (1) have trading rights of import and export, or qualifications of international business of economic cooperation; (2) have no unlawful acts as to administration of import and export business, financial administration, taxation administration, foreign currencies administration and customs administration, etc; (3) have entered into contracts with one or more providers of service outsourcing business to offer medium or long term service, with annul incomes from service outsourcing business no less than USD 1.5 million (incomes from offshore service outsourcing business shall be more than 70% of the total amount); or (4) have the qualification to take the business of service outsourcing, and qualified staff for market exploring and project management of service outsourcing, and more than 70% of the total employees are graduated from universities (including three-year colleges) or have higher degrees. 9. It is required to use the Exploring Fund complying with related laws, regulations and financial rules of the state. Commercial authorities shall, in accordance with related provisions of the state, the Administration Measures, the Implementation Rules and the requirements hereof, check strictly, and do well the work of awarding the service outsourcing enterprises acquiring certification and support their business of international market exploring. 10.
