As the competent department of the State Council for comprehensive administration of the national labor and social security affairs£¬the Ministry of Labor and Social Security(MOLSS) is entrusted with the following tasks:
1, formulating the overall basic guidelines, policies and reform initiatives concerning labor and social security system; formulating development plan and annual plan of labor and social security and ensuring their implementation.
2, drafting laws and regulations, formulating administrative regulations and basic standards concerning national labor and social security, and organizing the enforcement thereof and formulating administrative rules of consultant organizations; representing government to undertake the supervision power of labor and social security; planning development of labor market; organizing the establishment and optimization of employment system; formulating plan and policy concerning reposition of laid-off workers, basic living insurance, re-employment; organizing the implementation of re-employment projects; formulating management rules of profession recommendation organization; formulating policy concerning development of surplus rural labor, rural labor flow orderly, and ensuring enforcement thereof; according to labor-division, formulating exit-employment and enter-employment policy; formulating management measures concerning delegates of related organizations to foreign enterprises; formulating qualification management measures of foreign organizations in China engaging labor application-agency, consultation, and training.
3, organizing the formulation of profession classification, national standard of professional skill, and industrial standards; establishing profession certificate system and profession skill authentication policy; under guideline and policy of state education, formulating rules, policy, and measures of the training, honor, and bonus of professionals and profession skill competition; formulating implementation measures of pre-labor system; formulating timetable and rest regulation of employee, and protection policy for female workers, minority workers, and special work; managing policy-arrangement and adjustment, and participating in assessing of national worker model;
4, formulating macro-policy and measures of employ payment; formulating related policy of enterprise payment directive line; formulating industrial payment adjustment policy and payment allocation of operators of SOEs; formulating related policy of enterprise payment directive line; formulating industrial payment adjustment policy and SOEs operator payment allocation policy; checking payment total amount of enterprise under direct control of central government and payment standard of responsible managers.
5, formulating basic policy and standard of retiree, unemployment, medical care, labor injure, and birth social insurance, and ensuring enforcement thereof.
6, formulating policy of social insurance fund collection, payment, management, and operation; raising check suggestions of social insurance budget; checking social insurance fund; formulating qualification recognition of social insurance agency and operational organization; formulating plan of social insurance service system, and ensuring enforcement thereof.
7, formulating policy of supplementary endowment insurance and medical insurance of governmental organization, public institution, and enterprises, and qualification recognition standard; checking the qualification of the recognition of organizations undertaking supplementary insurance business.
8, undertaking statistics and information work of national labor and social insurance; organizing the construction of national labor and social insurance network; announcing communiqu¨¦, information, and development forecast report regularly.
9, organizing scientific and technological research and promotion of outcome, and industry development of labor and social security domain; responsible for the standardization work.
10, responsible for international communication and cooperation, on behalf of government to participate in activities of International Labor Union and other international organizations; managing governmental, civil, and multilateral and bilateral international communication and cooperation projects of international economic aid organization; managing technology cooperation and human resource exchange; checking international labor pact and proposal.
11, other issues assigned by State Council.
